Policies
Terms and Conditions
Effective date: October 25, 2026
Introduction
These terms and conditions (these “Terms” or this “Agreement”) govern the relationship between On the Go Vacations (“OTGV,” “we,” “us,” or “our”) and you, the purchaser or traveler (“Client,” “you,” or “your”). By accepting these Terms in writing or electronically, or by making a booking with OTGV, you agree to be bound by them.
You acknowledge that OTGV acts solely as a booking agent for disclosed principal suppliers, including tour operators, cruise lines, airlines, hotels, bus companies, ground transportation providers, boat owners and operators, and other independent contractors providing accommodations, transportation, and other services (“Supplier” or “Suppliers”). OTGV is not the source or provider of the travel services. These Terms include warranties, disclaimers, and exclusions of liability that may restrict your rights and remedies and provide protection to OTGV.
Use of OTGV Services and Booking Authority
You warrant that you are at least 18 years of age and have the legal authority to enter into this Agreement and to make travel bookings with OTGV. You agree to be financially responsible for all travel bookings you make with us, whether for yourself or for other members of your traveling party. You warrant that all information you supply for yourself, members of your household, or others for whom you are authorized to transact business with us is true and accurate. You agree to make only legitimate reservations or purchases, and you acknowledge that any speculative, false, or fraudulent reservation is prohibited.
Lead traveler. If you book on behalf of others, you warrant that you are authorized to accept these Terms on behalf of every member of your traveling party, that you will provide each of them with a copy of these Terms, and that each of them agrees to be bound by them.
Written approval. OTGV will not make a booking until you have approved the itinerary and price in writing. Approval by email or text message counts as written approval.
Ownership of proposals. All itineraries, quotes, proposals, recommendations, and research prepared by OTGV are the property of OTGV and are provided for your personal use in booking with OTGV only. You may not share them with, or use them to book through, any other travel agency or booking service.
Booking Agent and Supplier Terms
OTGV accepts all bookings solely as the booking agent for the Suppliers on your itinerary. Each Supplier’s own terms and conditions apply to the travel services you select. By booking through OTGV, you also agree to the booking terms of each Supplier on your itinerary, and you agree to abide by any Supplier’s terms and conditions of purchase.
Commission disclosure. OTGV may receive commissions, incentives, or other compensation from Suppliers in connection with your booking.
Independent Arrangements
OTGV is not responsible for any arrangements made independently of OTGV. OTGV assumes no responsibility for costs or fees you incur for arrangements not booked through OTGV, including, but not limited to, airline, hotel, excursion, and travel protection charges. If you make your own flight arrangements, OTGV is not responsible for any loss resulting from cancellations or changes to international gateways, itineraries, or travel dates, and cannot assist with schedule changes or delays related to air reservations you have made independently.
It may not be possible to earn frequent flyer or other loyalty points on reservations in your itinerary. With limited exceptions, hotel and airline rewards or points cannot be redeemed for travel arrangements made by OTGV.
Seller of Travel Disclosure
OTGV is an independent contractor of Cruises and Tours Unlimited, California Seller of Travel 2090937-50 (Registered Affiliate), Florida ST15578, Iowa Registered Agency No. 1202, Washington 603189022. Registration as a seller of travel does not constitute approval by the State of California.
OTGV Professional Service Fees
OTGV generally provides travel planning, consultation, and booking services without charging additional agency service fees. However, OTGV reserves the right to charge planning, consultation, booking, change, cancellation, or other professional service fees (“OTGV Fees”) when warranted by the nature, complexity, or scope of the services requested.
Any applicable OTGV Fee, including its amount, payment terms, and refundability, will be disclosed to you in writing and must be accepted before OTGV begins the fee-based services or charges the fee. No OTGV Fee will be imposed retroactively without your express agreement.
Unless otherwise stated in the written fee agreement and subject to applicable law, OTGV Fees are fully earned and nonrefundable once OTGV begins performing the agreed-upon services, regardless of whether the planning process is completed or a travel booking is ultimately made, including if:
- You subsequently cancel or change your travel plans.
- A Supplier cancels, changes, or refunds your booking.
- Your travel is affected by a Force Majeure event.
- You decide not to book after OTGV has begun providing the agreed-upon planning services.
OTGV Fees are separate from any charges, deposits, penalties, or fees imposed by travel Suppliers. Any applicable OTGV Fee will be billed separately by OTGV and will not be included in Supplier travel payments.
Right to Correct Errors, Pricing, and Availability
We reserve the right to correct errors. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. All offers, incentives, and Supplier promotions are subject to availability and may change without notice.
Quoted prices are not guaranteed until a deposit is paid and the booking is confirmed. Once a deposit is paid, most prices are guaranteed under the Supplier’s terms. However, some Suppliers reserve the right to add fuel surcharges, taxes, port charges, government fees, or currency adjustments after booking, and you agree to pay any such charges the Supplier imposes. You are advised to confirm reservations well in advance of your travel dates to avoid disappointment, fare increases, and late booking fees.
Payments
You are responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through OTGV. All payments for travel arrangements are processed directly by the applicable Supplier. OTGV does not collect, hold, or deposit Client travel payments into its own bank accounts. By providing payment information and authorizing a transaction, you authorize OTGV to submit that information to the applicable Supplier for processing on your behalf. Charges for travel arrangements will appear on your statement under the Supplier’s or its authorized payment processor’s name, and your card issuer may apply foreign transaction fees. Any OTGV Fees are billed separately by OTGV.
All payments for travel are due before departure according to each Supplier’s terms and conditions. Failure to make final payment, or any violation of a Supplier’s conditions of purchase, may result in cancellation of your reservations, denial of access to flights, tours, hotels, cruises, or other travel services, or forfeiture of any money paid.
Payment Disputes, Chargebacks, and Client Responsibility
Although OTGV does not collect or hold Client travel funds, certain Suppliers may hold OTGV financially responsible for chargebacks, payment reversals, or disputed transactions associated with reservations made through OTGV.
Acknowledgment of payment obligations. By authorizing payment, you acknowledge that you have reviewed and accepted the applicable Supplier’s payment, cancellation, and refund policies, including any nonrefundable deposits, cancellation penalties, and restrictions on changes or refunds. You acknowledge that cancellation of travel arrangements, dissatisfaction with a Supplier’s policies, or a change in personal travel plans does not, by itself, eliminate payment obligations arising under the agreed booking terms.
Resolution of payment concerns. If you believe a charge is incorrect or a refund is due, OTGV encourages you to contact us promptly at jeni@otgvacations.com so we can help you communicate with the applicable Supplier and seek a resolution. Nothing in this provision requires you to delay exercising any rights available under applicable law.
Improper chargebacks and financial responsibility. You agree not to initiate or maintain a payment dispute or chargeback that is fraudulent, materially false, or made to avoid charges you agreed to under the booking terms, such as a properly disclosed and enforceable nonrefundable deposit or cancellation penalty, when the Supplier provided, or remained ready to provide, the services as booked.
If a chargeback or payment reversal results from your fraudulent conduct, material misrepresentation, or other breach of your enforceable payment obligations, including disputing a properly disclosed and enforceable nonrefundable deposit or cancellation penalty when the Supplier provided, or remained ready to provide, the services as booked, and OTGV is subsequently held financially responsible by a Supplier, you agree to reimburse OTGV for the actual, documented losses directly resulting from that conduct, to the extent permitted by applicable law. Such losses may include amounts OTGV is contractually required to reimburse the Supplier, chargeback processing fees, and reasonable collection costs, including attorneys’ fees where recoverable by law. OTGV will provide documentation supporting any reimbursement request and will not seek duplicate recovery of amounts already refunded, recovered, or otherwise reimbursed.
Preservation of legal rights. Nothing in these Terms restricts your right to dispute unauthorized transactions, billing errors, services not provided, or other matters protected by applicable consumer protection laws. Exercising those rights in good faith does not, by itself, create liability to OTGV.
Cancellations and Refunds
In some cases, there is NO REFUND once a booking is made and under deposit. You may not be entitled to a refund if you change or cancel your travel plans after a booking is confirmed. All cancellation requests must be sent to OTGV in writing at jeni@otgvacations.com. Supplier cancellation penalties will be assessed and processed by the applicable Supplier in accordance with its policies. Any separately agreed-upon OTGV Fees will be governed by the OTGV Professional Service Fees section of these Terms.
Refunds, when applicable, are processed directly by the Supplier to the original payment method or through another method permitted by the Supplier’s policies and applicable law. OTGV does not receive, hold, or issue refunds and is not responsible for the amount or timing of any Supplier refund. Future cruise credits, travel vouchers, and other Supplier credits are not cash and are not redeemable for cash from OTGV. When tour, cruise, or package prices are based on Supplier contract rates, you are not entitled to a refund for any unused portion of travel.
Changes to Bookings
If you wish to change any portion of your confirmed arrangements before departure or during your trip, we will try to assist you. Some bookings cannot be changed. You are responsible for any cost increases imposed by the Supplier, as well as any Supplier change fees and applicable OTGV Fees. All change requests must be made in writing to OTGV at jeni@otgvacations.com.
Travel Documents and Identification
Each Client is responsible for obtaining and carrying a valid passport book, any required visas, and all other documents required by applicable government regulations. Passport cards are not valid for international air travel; they may be used only for land and sea travel between the United States and Canada, Mexico, the Caribbean, and Bermuda.
The U.S. Transportation Security Administration (TSA) requires travelers age 18 and older to present a REAL ID-compliant driver’s license or other acceptable identification, such as a U.S. passport, to board domestic flights. A list of acceptable identification is available at www.tsa.gov.
Passport validity requirements vary by destination, nationality, and any country you transit. Many countries require a passport to be valid for at least six (6) months beyond your planned departure, and some require blank visa pages. You are responsible for confirming the requirements for every country on your itinerary, including transit countries. Non-U.S. citizens may require additional documentation, and you must tell OTGV if you are traveling on a passport issued by a country other than the United States. OTGV neither controls nor guarantees the issuance of visas or approval of visa waivers. If a visa is not issued, OTGV is not responsible for payments made toward your trip. Entry and exit rules may change at any time.
Minors. Children and infants may also require travel documents. Minors traveling with one parent, or without either parent, may be denied entry unless authenticated consent forms are provided; see help.cbp.gov for more information. U.S. and Canadian citizen children under age 19 traveling with a school, religious, social, cultural, or sports group and entering the United States by land or sea from Canada or Mexico may present an original or copy of a birth certificate, Consular Report of Birth Abroad, or Naturalization Certificate. Written consent from a parent or legal guardian must be provided to the supervising adult or group leader.
Names must match. The name, date of birth, and gender on your identification must exactly match your tickets and booking records. It is your responsibility to ensure the information on your tickets and confirmations is accurate. Any discrepancy may result in denied boarding or delays that cause you to miss your flight and any later travel bookings, including cruises and tours.
WHEN YOU RECEIVE YOUR TRAVEL DOCUMENTS, IT IS YOUR RESPONSIBILITY TO REVIEW AND VERIFY ALL INFORMATION FOR ACCURACY. CONTACT OTGV IMMEDIATELY IF CHANGES OR CORRECTIONS ARE REQUIRED. IF YOU HAVE NOT NOTIFIED US OF NECESSARY CORRECTIONS WITHIN TWENTY-FOUR (24) HOURS OF RECEIVING YOUR TRAVEL DOCUMENTS, OTGV BEARS NO RESPONSIBILITY FOR ANY ADDITIONAL COSTS OF MAKING THOSE CORRECTIONS.
Individual Entry and Exit Requirements
Each country treats past criminal offenses differently, whether committed inside or outside its borders. If you have a current or prior criminal offense, contact the destination country directly about its entry and exit requirements. More information is available from the U.S. Department of State at travel.state.gov. In the interest of our Clients’ privacy, we do not ask about criminal records. For example, travelers to or through Canada with a Driving While Intoxicated (DWI) record or judgments for unpaid child support should review current entry requirements at www.canada.ca.
Immunizations and Health Screenings
You must obtain all required immunizations and health screenings, and any required documentation of them, before travel. OTGV is not responsible for the accuracy of health, vaccination, or documentation requirements before departure or on arrival. Some required inoculations must be recorded by your health care provider on a valid vaccination certificate, which you must carry as proof. If you have concerns about medications or inoculations, consult your health care provider BEFORE booking. For destination information, see the U.S. Department of State website at travel.state.gov and the Centers for Disease Control and Prevention (CDC) at wwwnc.cdc.gov/travel.
Risks and Safety
Travel to some destinations involves greater risk than others. OTGV urges Clients to stay informed about current events and to review travel prohibitions, warnings, announcements, and advisories issued by the U.S. government before booking international travel. Information on health and safety conditions is available at travel.state.gov, www.tsa.gov, www.transportation.gov, www.faa.gov, www.cdc.gov, and www.cbp.gov.
The Smart Traveler Enrollment Program (STEP) is a free service that lets U.S. citizens traveling abroad register their trip so the Department of State can better assist them in an emergency. Registration is recommended at step.state.gov.
BY OFFERING TRAVEL TO PARTICULAR DESTINATIONS, OTGV DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO THOSE DESTINATIONS IS ADVISABLE OR WITHOUT RISK, AND IS NOT LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM SUCH TRAVEL. CLIENT’S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH RISKS.
“Sail with Me” Group Cruises
From time to time, OTGV may promote group cruises on which an OTGV advisor sails with the group as a host (“Sail with Me” cruises). For these cruises, the following terms apply in addition to the rest of these Terms:
- Host, not operator. The cruise line provides all transportation, accommodations, meals, and onboard services. The presence of an OTGV host does not make OTGV the operator of the cruise or responsible for the cruise line’s services.
- Hosted events are optional extras. Gatherings, amenities, gifts, or perks organized by OTGV are provided as a courtesy, may change or be canceled at any time, and do not entitle anyone to a refund or credit.
- No supervision. The OTGV host is not responsible for supervising or chaperoning any guest, including minors, and does not provide medical, security, or emergency services.
- If the host cannot sail. If the OTGV host is unable to travel for any reason, the cruise proceeds as booked. OTGV may provide a substitute host or cancel hosted events, and no refund or compensation is owed.
- Group benefits depend on the group. Group rates, amenities, and onboard credits are governed by the cruise line’s group contract and may change or be withdrawn if the group does not meet the cruise line’s minimum requirements.
- Group deadlines. Deposit, final payment, and name-change deadlines under a group contract may be earlier than the cruise line’s standard terms. You agree to meet the deadlines OTGV provides to you in writing.
Photos and testimonials. By participating in a Sail with Me cruise or other OTGV-hosted event, you consent to OTGV’s use of photos and video taken during the trip or event, and of any review or testimonial you provide, in OTGV’s marketing materials, website, and social media, without compensation. If you do not want to appear, notify OTGV in writing at jeni@otgvacations.com before departure, and OTGV will not use images in which you are identifiable.
Limitations of Responsibility
OTGV acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of any travel service. Each Supplier is an independent business with its own management and is not under OTGV’s control. The Suppliers named in your travel documents are responsible for providing the travel services purchased, and you consent to the use of those Suppliers.
A Supplier may change an itinerary for any number of reasons, including severe weather. Any change to an itinerary is at the Supplier’s sole discretion, and OTGV is not responsible for it.
BECAUSE OTGV ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT SUPPLIERS, YOU AGREE THAT OTGV IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE ARISING OUT OF THEIR SERVICES. OTGV DISCLAIMS ANY LIABILITY, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY SUPPLIER BOOKED THROUGH OTGV, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY, OR IRREGULARITY CAUSED BY THE FAULT, NEGLIGENCE, WILLFUL ACTS, OR OMISSIONS OF ANY SUPPLIER OR ITS EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, THEIR CANCELLATION AND REFUND POLICIES, FUEL INCREASES, BANKRUPTCY, OR CESSATION OF OPERATIONS, AND OTHER MATTERS OUTSIDE OTGV’S CONTROL. YOU RELEASE OTGV FROM ANY LIABILITY FOR THE SAME.
OTGV RECEIVES ONLY COMMISSIONS AND FEES FOR TRAVEL TRANSACTIONS. YOU AGREE THAT ANY RECOVERY FROM OTGV IS LIMITED TO THE COMMISSIONS AND FEES ACTUALLY RECEIVED BY OTGV FOR THE SPECIFIC BOOKING GIVING RISE TO THE CLAIM.
Special Requests and Recommendations
Special requests. Requests for accessibility accommodations, room location or view, bed type, dietary needs, celebrations, and similar preferences are passed to the Supplier as requests only and are not guaranteed. To arrange a requested accommodation, or where a Supplier’s policies require it (for example, cruise line pregnancy or mobility-device policies), you agree to give OTGV, before booking, the information reasonably necessary for that purpose. OTGV will share it only with the Suppliers involved. You are responsible for reviewing any Supplier restrictions that may apply to your circumstances.
Recommendations. OTGV’s descriptions, opinions, and recommendations about destinations, properties, Suppliers, and experiences are based on professional judgment and available information, and are subjective. OTGV does not guarantee that any Supplier or experience will meet your expectations.
Force Majeure
OTGV will not be in breach of these Terms or otherwise liable to you for any failure or delay in performing an obligation under this Agreement caused by events beyond its reasonable control, including: acts of God; accidents; riots; war; terrorist acts; epidemics, pandemics, or quarantines; civil unrest; failure of communication facilities, including web hosts and internet service providers; equipment breakdown or malfunction; destruction of or serious damage to facilities; natural disasters, including extreme weather, floods, and volcanic eruptions; acts or omissions of government; changes in laws or regulations; strikes; fire; explosion; general shortages of materials or energy; and any other unforeseen circumstance beyond OTGV’s control (“Force Majeure”). THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.
Each of OTGV’s Suppliers has its own terms and conditions, including Force Majeure provisions. If a Force Majeure event occurs, a Supplier may, at its sole discretion, change, postpone, or cancel any itinerary or arrangement. Any refund resulting from non-performance is at the Supplier’s sole discretion under its policies, although OTGV will use reasonable efforts to help secure reimbursement for you where possible.
Client Conduct
When you book with OTGV, you accept responsibility for any damage or loss caused by you or members of your traveling party. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid directly at the time to the accommodation owner, manager, or other Supplier. You agree to indemnify OTGV for the full amount of any claim, including legal costs, made against OTGV arising from your conduct or that of your traveling party.
A Supplier may remove a traveler from a trip, or any part of a trip, for conduct it considers unacceptable. OTGV is not responsible for any costs incurred by a traveler who is removed, and no refund is owed. You agree not to hold OTGV or any of its related entities liable for any action taken under these Terms. Baggage and personal belongings are at all times the sole responsibility of the traveler.
Any transportation, possession, or use of illegal drugs may result in removal from your trip and prosecution. Removal from a Supplier-operated service is decided by the Supplier or local authorities, not OTGV, and no refund is owed by OTGV. You are responsible for knowing and following the laws governing the possession of drugs, including prescription and over-the-counter medications, in every country and state you visit. Some laws require you to carry a prescription from your doctor.
Right to decline or end service. OTGV may decline to provide services, or stop providing them, to any Client who is abusive, fails to pay, provides false information, or violates these Terms. Any OTGV Fees already paid remain earned for services already begun.
Travel Insurance
OTGV OFFERS ACCESS TO TRAVEL INSURANCE TO HELP PROTECT CLIENTS AND THEIR INVESTMENT IN TRAVEL. UNLESS SPECIFICALLY NOTED, TRAVEL INSURANCE IS NOT INCLUDED IN THE COST OF YOUR ITINERARY. DEPENDING ON THE POLICY, TRAVEL INSURANCE MAY COVER RISKS SUCH AS SUPPLIER DEFAULT OR BANKRUPTCY; TRIP DELAY, INTERRUPTION, AND CANCELLATION; MISSED CRUISE CONNECTIONS; MEDICAL EMERGENCIES, EVACUATION, AND REPATRIATION; LOST, DAMAGED, OR DELAYED BAGGAGE; ILLNESS; JOB LOSS AND CHANGE OF PLANS; ACCIDENTAL DEATH AND DISABILITY; AND TRAVEL ACCIDENT AND SICKNESS MEDICAL EXPENSES.
Without appropriate travel insurance, you understand and agree that if you cancel or interrupt your travel for any reason, portions of your trip may not be refunded, and Supplier cancellation penalties and any applicable OTGV Fees will apply, which may result in the loss of up to the full cost of your travel and related costs.
Insurance waiver required. Purchasing travel insurance is not required to buy any other product or service from OTGV. However, if you decline travel insurance offered or recommended by OTGV, you must sign a written insurance waiver before your booking is finalized.
OTGV is not a licensed insurance agent or broker, and its advisors are not qualified or authorized to answer technical questions about the benefits, exclusions, or conditions of any insurance policy, or to evaluate the adequacy of your existing coverage. An additional charge applies for any travel insurance you select. It is your responsibility to understand what your policy covers and to arrange other coverage for any conditions it excludes. OTGV CANNOT GUARANTEE THAT ANY INSURANCE PROVIDER WILL APPROVE A CLAIM AND MAKES NO REPRESENTATIONS ABOUT THE EXTENT OF COVERAGE UNDER ANY POLICY IT MAY OFFER OR QUOTE.
Privacy, Communications, and Electronic Signatures
You authorize OTGV to share your personal information, and that of your traveling party, with Suppliers, insurance providers, and others as needed to make, manage, and service your bookings.
You agree that OTGV may send notices, documents, and other communications to the email address or phone number you provide, and that these communications satisfy any requirement that they be in writing. Your electronic signature, checkbox acceptance, or written approval by email or text has the same effect as a handwritten signature.
Business hours and emergencies. OTGV’s business hours are Monday through Friday, 9:00 a.m. to 5:00 p.m. Central Time, excluding holidays. OTGV will make reasonable efforts to respond to messages within one (1) business day; messages received outside business hours will be handled on the next business day. OTGV does not provide 24-hour assistance. During travel, for urgent matters such as delays, cancellations, missed connections, or medical emergencies, contact the Supplier directly or your travel insurance provider’s 24-hour assistance line first.
Changes to These Terms
OTGV may change these Terms at any time. Updated versions will be posted on our website and provided to Clients. The version of these Terms in effect when a booking is confirmed governs that booking, unless you agree otherwise in writing. Updated Terms apply to all bookings confirmed after they are posted.
General
Governing law and venue. The laws of the State of Texas govern these Terms. You consent to the exclusive jurisdiction and venue of the courts in San Patricio County, Texas, for all disputes arising out of or relating to these Terms or travel booked with OTGV.
Complaints. Any problem with a travel service must be reported to the Supplier during your trip so the Supplier has an opportunity to resolve it. Any complaint regarding your travel must also be submitted to OTGV in writing at jeni@otgvacations.com within thirty (30) days after your return. OTGV will make reasonable efforts to help you seek resolution from the Supplier.
Time limit for claims. Any claim against OTGV must be brought within two (2) years after the date the trip was completed or was scheduled to be completed, and not later.
Damages. OTGV is not liable in any case for damages other than compensatory damages, and you waive any right to claim punitive or exemplary damages.
Attorneys’ fees. In any dispute arising out of these Terms or travel booked with OTGV, the prevailing party is entitled to recover its reasonable attorneys’ fees and costs.
Class action waiver. You may bring claims only in your individual capacity, and not as a plaintiff or class member in any class action, purported class action, or other representative proceeding. You expressly waive any right to bring or participate in such actions.
Severability. If any part of these Terms, including the warranty disclaimers and liability limitations above, is found invalid or unenforceable under applicable law, that provision will be replaced by a valid, enforceable provision that most closely matches its intent, and the remainder of these Terms will continue in effect.
Survival. All provisions of these Terms that by their nature should survive the completion or cancellation of your travel, including payment obligations, limitations of liability, indemnification, and the provisions in this General section, will survive.
Assignment. OTGV may assign these Terms, and any booking made under them, to any affiliate or successor business, including any limited liability company formed by its owner, without Client’s consent. Client may not assign these Terms or any booking without OTGV’s written consent.
Notices. All written notices to OTGV, including cancellation and change requests, must be sent by email to jeni@otgvacations.com. A notice is effective when OTGV receives it. Notices sent by any other method, including social media, voicemail, or messages to a Supplier, are not effective notice to OTGV.
Entire agreement. These Terms, together with any written fee agreement, signed booking forms, and Supplier terms and conditions referenced in them, are the entire agreement between you and OTGV regarding travel booked with OTGV by any means, and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, regarding their subject matter. A printed version of these Terms and of any notice given electronically is admissible in judicial or administrative proceedings to the same extent and under the same conditions as other business records originally created and kept in printed form.
